What Is an Affidavit of Residence?

An affidavit of residence is a sworn legal statement confirming that a person lives or has lived at a specific address. It is signed by a witness who has personal knowledge of the person's residence — typically a landlord, neighbor, family member, or employer.

When You Need This Document

  • Vietnamese Driver's License: Foreigners applying for a Vietnamese driver's license must prove their temporary residence in Vietnam. This affidavit satisfies that requirement.
  • USCIS Immigration: Some immigration forms require proof of residence history. This affidavit can supplement utility bills, lease agreements, or other residence documents.
  • Visa Applications: Proving ties to a home address strengthens visa applications and reduces the risk of 214(b) denial.
  • Legal Proceedings: Courts and government agencies in both Vietnam and the US may require sworn proof of residence.

Two Versions Available

  • Bilingual (English & Vietnamese): For use when Vietnamese-speaking witnesses need to understand the document they are signing.
  • English Only: For use in US legal proceedings where only English is required.

Instructions

  1. Fill in the full name and address of the person whose residence is being confirmed.
  2. The witness completes their section with their name, relationship to the subject, and their own address.
  3. Both parties sign. Notarization is recommended but not always required.
  4. Keep copies — originals can get lost in the mail or at government offices.

Who can be a witness on an affidavit of residence?

Anyone with personal knowledge of the person's residence — a landlord, neighbor, family member, employer, or hotel manager. The witness must be willing to sign a sworn statement.

Is this accepted for the Vietnamese driver's license application?

Yes. This is one of the accepted forms of proof of temporary residence required by the Vietnamese Department of Transportation when applying for a driver's license as a foreigner.

Does it need to be notarized?

For Vietnamese government purposes, having it stamped by a local authority (UBND phường/xã) is often more useful than a US-style notarization. For US immigration, a notary public stamp is preferred.
